More charged in relation to Plush Lounge parking lot shooting

A second man has been charged with murder in connection to a shooting at the Plush Lounge parking lot early Sunday morning that left one dead and four others hurt.

Justin Lamarr Simpson, 40, is charged with second-degree murder, armed criminal action, unlawful possession of a gun and attempted unlawful use of a weapon. He is not in custody. A warrant was issued on Thursday and no bond is set.

Police say he was observed on security footage shooting a rifle, according to the probable cause statement.

According to the probable cause statement, officers observed video of Simpson shooting toward the homicide victim, Melvin Hooker III, among others in the parking lot.

Court documents state Simpson pulled into the parking lot and began walking towards the white INFINITI G35x that the victim was standing near while carrying a rifle. He began shooting toward a victim named "MH" before he fell to the ground. Simpson continued to fire in the direction of MH after he fell and kept shooting.

Documents said Simpson stood at the doorway of Plush Lounge and continued to fire.

The probable cause statement said a witness present during the shooting identified Simpson as a shooter. The witness also identified a red KIA Sorento parked in the parking lot as Simpson's car. Officers were then able to run the registration through MULE and found the car was registered to a person who lives at the same address as Simpson.

According to the probable cause statement, Simpson is a convicted felon dating back to 2008, which prohibits him from possessing a gun.

Another man was charged in relation to the case. Samuel Lee Moss, 28, was charged with unlawful use of a gun, illegal gun possession and armed-criminal action. Moss is being held without bond at the Boone County Jail. One witness talked to police and allegedly recognized a man wearing an orange hat as, "Sam," according to the probable cause statement.

Another witness and a detective also identified Moss from security footage, according to the probable cause statement. A court date for Moss has not been set.

Spivey appears in court

Kimo Spivey, 33, was charged earlier this week with second-degree murder in the shooting and had a bond hearing Thursday. Spivey, who already has charges in another case, including second-degree domestic assault and third-degree assault, said in court he didn't know what case he appearing for.

Spivey has private council for his other cause and is trying to get another lawyer for this one.

Spivey's next court appearance is 1 p.m. Thursday. In the case involving the second-degree domestic assault and third-degree assault charges, a hearing is set for 10:30 a.m. Monday, according to Casenet.

Since the shooting, Plush Lounge has announced it's "closing indefinitely."
