33-year-old suspect, Kimo Spivey is expected to make an appearance in court Thursday afternoon for a bond hearing.
According to online court records, Spivey is facing several charges for the shooting death of Melvin Hooker III. The 33-year-old is charged with second-degree murder, armed criminal action, and weapons charges.
Police responded to reports of multiple shots being fired early Sunday morning near Plush Lounge in the parking lot near North Boulevard and 8th Street. When officers arrived, Hooker was pronounced dead at the scene.
On Wednesday, Plush Lounge posted to their Facebook page announcing the establishment is "closing indefinitely" and working with authorities. The post said, "we are also committed to utilizing this time to reevaluate how we can ensure the safety of the community entrusted to us with their patronage."
Court documents say a witness allegedly told police Hooker was involved in an argument with a group of people and then went to the passenger side door of his car to get a gun. The witness told police Spivey approached her and Hooker with a gun in his hand.
The two exchanged words and then she allegedly told police she saw Spivey "shoot and kill Hooker,” according to the probable cause statement.
This wouldn't be the first time Spivey is accused of being involved in an act of violence. According to online court records, Spivey is facing charges in another case, including second-degree domestic assault and third-degree assault. The 33-year-old also previously pleaded guilty to second-degree assault in 2014 and spent three years in the Missouri Department of Corrections.
Spivey is expected to appear at the Boone County Courthouse at 1:00 p.m. on Thursday.
Spivey's preliminary hearing is scheduled for May 30th according to online court records.
