Man accused of randomly attacking another man at Jefferson City bar

JEFFERSON CITY, Mo. (KMIZ)

A Jefferson City man was charged with a pair of felonies and a misdemeanor after he allegedly attacked another man at Chick’s Taproom in Jefferson City.

Nicolas Montgomery, 35, was charged with second-degree assault, resisting arrest and fourth-degree assault, a misdemeanor. He is being held at the Cole County Jail without bond and a court date has not been set.

According to the probable cause statement, Montgomery was drunk and was allegedly trying to fight several people at the bar, along with another man who was not identified in the probable cause statement. Montgomery allegedly refused to identify himself to officers when they arrived around midnight Tuesday.

The manager of the bar allegedly had told Montgomery to pay his tab and leave, but Montgomery refused, the statement says. He had allegedly told police that he “wanted to handle the situation ‘the hard way’ and slammed his phone on the bar top while staring at Officers in an aggressive manner,” the statement says.

Police arrested Montgomery while he was resisting, the statement says.

A witness had allegedly told police that Montgomery and another man were trying to pick fights with people at the bar, the statement says. The witness and the victim had no affiliation with either man, the statement says. The victim was found by the witness on the ground with blood gushing from their head, the statements says.

The victim later told police at an emergency room that he was standing on the southwest side of the building near a retaining wall, court documents say. The victim reiterated to police that Montgomery and the other man had been “trying to fight everyone,” the statement says. The victim claimed that Montgomery had sucker-punched him unprovoked and the victim lost consciousness after about 15 seconds, court documents say.

The victim had a 3-inch cut that required stitches and was also bleeding from one of their ears when police spoke with them, court documents say.
