Wrongful death lawsuit filed against truck owner in deadly 2021 crash near Centralia
BOONE COUNTY, Mo. (KMIZ)
Lawyers for the husband of a woman killed in a Boone County crash last year have filed a wrongful death lawsuit.
Nathanial Simmerman is suing Johnny Peery, of Mexico, Missouri, for negligence in the death of his wife, Cassandra Simmerman, 30, of Clarence, Missouri, and unborn child, according to court documents.
Rachael Hultz is also suing Peery for the death of her unborn child.
Peery is accused of letting Monte Hayes drive a flatbed truck without a valid driver's license. The truck also wasn't registered, according to court documents. The lawsuit says Peery is the owner and operator of the flatbed truck.
Missouri State Highway Patrol troopers said Hayes lost control of the truck on Highway 22 northwest of Centralia after a tire blew out on Aug. 10. The truck crashed into the car driven by Hultz. Cassandra Simmerman was a passenger in the vehicle. Emergency crews pronounced her dead at the scene.
Nathanial Simmerman and Hultz have requested a jury trial to hear their claims against Peery.
ABC 17 News was unable to reach Peery for a comment.
