Settlement approved in Waffle House shooting case

A judge has approved a settlement between Waffle House, security company Signal 88 and the family of a man killed in a shooting at a Columbia restaurant.
Judge Jeff Harris approved the confidential settlement in Boone County court Monday, court records show. Â The terms of the settlement are confidential, but the motion filed last month by A.W. Smith, the lawyer for Anthony Warren's family, notes that structured settlements are in place for Warren's three children.
A private security guard fatally shot Warren after a fight broke out at the Waffle House on Vandiver Drive on New Year's Day 2018. The guard, Robert Moses, was breaking up a fight between two other people when a third person threw a carafe at him. Moses then turned and fired at Warren, who was standing nearby but uninvolved.
A jury convicted Matthew McMillan of felony murder for Warren's death because McMillan and another man began fighting in the Waffle House, which caused Moses to intervene. Prosecutors did not charge Moses for the shooting.
In his motion, Smith said Waffle House and Signal 88 deny liability as part of the settlement. Attorneys are set to collect about 40% of the settlement, according to the motion.
Warren's family has argued that Moses was not competent as an armed security guard. He failed a shooting test several times before getting his license from the city of Columbia.
