Inmates injured in 2023 Boone County crash sue Department of Corrections, drivers

Three inmates who were injured in a December 2023 Boone County crash are suing the Department of Corrections.
Three petitions were filed on Wednesday. Raymond Nugen, Richard Kerksiek and Dustin Burkhart are suing the DOC, the driver of a transport van, a truck driver and SLC Leasing LLC for damages. The petitions filed accused the defendants of multiple counts of negligence.
Five inmates and two corrections officers were injured in the crash, previous reporting says.
According to previous reporting, Kerksiek is serving a 31-year sentence for multiple charges, including statutory sodomy and incest. Burkhart was found guilty last year of first-degree assault, first-degree burglary and armed criminal action. Nugen is serving five years for first-degree child molestation.
The lawsuit says that Jeremy Fulk was driving the van on Dec.12 on Highway 63 in Boone County and crashed into a 2019 Peterbilt tractor-trailer – driven by Bernard Kintz – that pulled onto Highway 63 from Highway 124.
