COLUMBIA, Mo. (KMIZ)

A Tipton man was recently charged with several counts relating to a fatal Aug. 6 crash in Moniteau County.

David Burnett, 45, was charged Thursday with driving while intoxicated with a blood-alcohol content greater than 0.18, driving a motor vehicle with an excessive BAC, driving without a valid license and driving without insurance.

The Missouri State Highway Patrol said Burnett was traveling eastbound on U.S 50 when his vehicle traveled off the right side of the road, overturning and ejecting both people inside.

A trooper at the scene said Burnett smelled of alcohol and the accident occurred after a passenger put their foot on a footrest and shifted their weight, according to a probable cause statement. Burnett told the trooper he consumed more than 15 drinks.

Burnett was transported to University Hospital in Columbia.

Charles Gagnon, 59, died at the scene.
