Family of Kansas woman files lawsuit in deadly Amtrak train derailment

MENDON, Mo. (KMIZ)

Another lawsuit has been filed after the deadly Amtrak train derailment in June in Chariton County.

The family of one of the victims who died in the crash filed a lawsuit against MS Contracting LLC., the group that owned the truck that crashed with the train, BNSF Railway and a BNSF Railway employee.

The suit was filed on behalf of Rachelle Cook from Kansas by her three adult kids.

The family has filed three counts in the lawsuit:

  1. wrongful death - the family is asking for more than $25,000
  2. negligence - the family is asking for the same amount - more than $25,000.
  3. loss of a spouse - where all parties are asking for a combined amount of more than $75,000 for living relatives.  

The family has requested a trial by jury in this case.

Her mother and daughter who were also on the train are also suing for their own injuries.

M.S. Contracting LLC, B.N.S.F., and Amtrak are all facing lawsuits from the crash and derailment in Chariton County.  

The lawsuits just like this most recent one argue that the three companies put those on the train at risk through negligence.
