Illinois man charged with BWI – death of another after August incident

A Camden County prosecutor has charged an Illinois man with BWI - death of another after a man died in August from a boating incident.

Dylan McEwen is charged with BWI - death of another, a class C felony.

Court documents state that a missing person was reported before 6:30 p.m. on August 8 near the 20.1-mile marker of the Osage arm at the Lake of the Ozarks.

The six people on the boat reported Sean Jouglard was missing after the group went swimming.

Investigators asked the people on the boat who was driving when Jouglard went missing; they pointed to McEwen, according to court documents.

A Missouri State Highway Patrol trooper reports he could smell the odor of alcohol on McEwen's breath. McEwen's speech was slurred and his eyes were watery and bloodshot, according to court documents. McEwen told the trooper he had been drinking since 1 p.m.

A search warrant was obtained to get a chemical blood test for McEwen. A lab analysis of the blood was returned on Sept. 2. McEwen's blood alcohol concentration was reported to be was .187%, three hours after the incident.

A former officer reported having video of the incident on August 9th. Officials report that Jouglard can be seen in the boat as it travels over several wakes and on the last wake, Jouglard was thrown from the boat, documents state.

A witness also reported seeing what happened and saw a man fly off the boat.

Jouglard's body was recovered on August 9th.

McEwen's initial court appearance is scheduled for Dec. 20.

Jouglard's parents filed a wrongful-death lawsuit against McEwen and two other men.
