Lawyers want to use victim’s blood alcohol as evidence

On Friday prosecutors asked a judge to block the blood alcohol and THC levels from a victim who was hit and killed by a suspected drunk driver in central Columbia.

Joshua Keller is charged with second-degree murder and felony DWI after a head-on crash that killed Sebastian Sneed on December 30, 2016. Keller had four previous DUIs.

Keller’s lawyer, Jenan Thompson, wants the jury to know the man killed in the crash, Sebastian Sneed, had a BAC twice the legal limit and active marijuana in his system.

Thompson argued Sneed’s decision to not wear a seatbelt and drive with alcohol and THC in his system are to blame for his death.

The prosecution said Sneed’s intoxication levels “do not dissolve” Keller of guilt.
