Man sues Capital Mall, Knockerball MidMo over injuries
A Boone County man has filed a lawsuit against Capital Mall JC LLC and Knockerball MidMo, LLC after allegedly suffering injuries, including paralysis.
The court documents say Derek Hart went to the Knockerball MidMo in the Capital Mall in December and paid to use the large inflatable balls made of rubber.
People are supposed to get into the knockerballs and play games like soccer, roll around or bump into each other.
Hart allegedly received no guidance or instruction from the employee working at the time and ended up suffering “severe, permanent, and painful injuries including paralysis.”
The suit also claims Zooms Sports, the company that manufactured the “knockerball” sold it to Knockerball MidMo in “defective condition.”
It alleges Hart was hospitalized and rendered unable to walk or use his arms. Due to the injuries, he’s lost wages and incurred medical bills.
The suit also says the store had hardwood floor in some areas and thin commercial grade carpet in other areas laid over a concrete floor.
On Knockerball MidMo’s website it says: “players must always be strapped in properly, play at their own risk and follow player guidelines in order to reduce the risk of injury.”
ABC 17 News called Hart’s attorney who declined comment. We also called Capital Mall and left a message for the general manager, but did not hear back Tuesday night. ABC 17 News also called the Knockerball MidMo location in the mall, but no one answered.
