Boone County prosecutor charges man shot by Sturgeon officer

UPDATE 9/9: The Grand Jury has indicted Charles Simcoe with third degree domestic assault, felonious restraint and assault of a law enforcement officer in the second degree, according to official court documents.

A special prosecutor is still looking into the assault of a law enforcement officer portion of the case.

ORIGINAL STORY: Boone County prosecutor Dan Knight told ABC 17 News he has filed charges against Charles Simcoe.

According the prosecutor, Simcoe is charged with felony domestic assault, felonious restraint, and felony assault of a law enforcement officer.

Authorities say Charles Simcoe was shot by a Sturgeon officer in July.

According to court Documents that ABC 17 News got today, the incident apparently started when a woman calledauthorities and said a drunk man was attacking her. Victim claims that Simcoe pointed a gun at her two times, and asked her if she wanted to be raped. The female victim was able to flee the residence and go to a nearby house to call 911.

Officials tell us the arriving officer shot Simcoe after he allegedly pointed his gun, which later turned out to be a BB gun, at the officer.

According to court documents, Simcoe has been missing his appointments with his parole officers. Authorities believe Simcoe is a danger to the community due to his criminal history of robbery, assault, and drug use.

Simcoe is currently being held at the Fulton Reception and Diagnostic Center.

ABC 17 News previously sent a mobile and text alert reporting that charges were filed against the officer. This was incorrect. Prosecutors have not said the officer involved in the shooting is facing any charges. ABC 17 News has sent alerts correcting that Charles Simcoe, the man shot by the officer, was charged.
