Mother of man killed in March motorcycle crash files wrongful death lawsuit

A wrongful death lawsuit has been filed in the death of Tyler Davis, the 23 year old killed in a motorcycle crash on March 28, 2016.

The lawsuit states that the defendant, Candace Burditt, failed to yield to oncoming vehicles traveling on MO-163. Burditt also caused, allowed, and permitted the motor vehicle she was operating to run into, strike, and collide with the motorcycle of Tyler Davis. Burditt failed to keep a careful lookout, and allowed herself to become distracted from exercising the highest degree of care while operating her motor vehicle.

The lawsuit also states that Burditt should have known that committing negligence, carelessness and recklessness would cause personal injury or death.

ABC 17 has checked in with the Boone County Prosecuting Attorney’s office, and no charges have been filled in the death, and no cases are under review as of now.

According to Columbia Police Department, Burditt was issued a misdemeanor in operating her motor vehicle in a careless and imprudent manner.
