Court delayed for suspect shot after allegedly firing at deputy
UPDATE: James Fainter, accused of shooting a Randolph County deputy, was expected to arraigned Monday, May 2, but ABC 17 News confirmed he is still in the hospital.
UPDATE:TheRandolph County Prosecutor has identified and charged the man accused of shooting at a deputy Monday after a chase.
Prosecutor Mike Fusselman tells ABC 17 News hefiled six feloniesagainst parolee James Fainter Tuesday.
Fainter is charged with two counts of assault on a law enforcement officer, two counts of armed criminal action, unlawful possession of a firearm and receiving stolen property. Court documents say the handgun used in the shooting was stolen from Audrain County.
According to court documents this isn’t James Fainter’s first run in with the law. Fainter has been in and out of prison three times since 2007. His first run in with the law was in 2006 in Boone County for delivering and manufacturing a controlled substance. Fainter was charged several more times from 2007 to 2011 in multiple counties for similar charges.
Missouri’s Probation and Parole board issued a warrant on Monday for Fainter’s arrest which means his parole will likely be revoked and that he will have to go to back to prison for the remainder of his sentence for the unlawful use of a weapon.
ORIGINAL STORY: The Missouri State Highway Patrol reports a suspect who led a Randolph County sheriff’s deputy on a pursuit Monday morning near Huntsville fired at deputies, before he was shot at least twice.
Missouri Highway Patrol Troop B Sgt. Brent Bernhardt says the suspect, a 34-year-old Moberly man, has been taken to University Hospital in Columbia with serious injuries. Bernhardt says there were no injuries to law enforcement personnel.
The Patrol’s Division of Drug and Crime Control is investigating. Bernhardt says the Patrol is being assisted by the Randolph County Sheriff’s Department, Moberly police, Huntsville police and the Randolph County Ambulance District.
Bernhardt says the incident began Monday morning at about 11 on Randolph County Road 2270, when a sheriff’s deputy tried to stop a 2000 Oldsmobile Bravada, which was occupied by a male driver and female passenger.
Bernhardt says the driver failed to stop for the deputy, and a pursuit ensued. Bernhardt says the vehicle traveled westbound on Route BB, north on Randolph County Road 2210 and then westbound on Highway 24, east of Huntsville.
Bernhardt says a Missouri State trooper successfully deployed a tire deflation device near Highway 24 and Route C. Bernhardt says the driver traveled on the north side of the road and stopped.
Bernhardt says the male suspect exited the Oldsmobile and began to run on foot. According to Bernhardt, as two Randolph County sheriff’s deputies began to give chase, “the suspect displayed a firearm and fired it toward the officers.” Bernhardt says Randolph County deputies returned gunfire and that the suspect was shot at least twice.
The Patrol says a woman in the passenger seat was detained for questioning.
