Prosecutors want death penalty for inmate accused of killing cellmate

A Missouri inmate charged with killing his cellmate had a hearing Wednesday.

Terry Volner appeared by video in Cole County Court Wednesday afternoon.

Prosecutors said he killed his cellmate, Jose Benitez, by hitting him.

The judge ruled that the state can obtain DNA from Volner

Prosecutors are seeking the death penalty.

Volner was already serving a life sentence for a previous murder conviction.

Volner’s trial is set for April 2016.
