Daughter of Columbia bicyclist files lawsuit

The daughter of a Columbia bicyclist killed on I-70 near mile marker 130 last Octoberhas filed a lawsuit in Boone County Court.

36-year-old Ennis Patrick was killed on October 26, 2013.

Columbia Police conducted a 2 month investigation into his death.

The investigation concluded, “it was likely the bicyclist was in the main-traveled portion of the roadway when he was struck by a semi truck.”

The lawsuit alleges that the truck driver left the main roadway and ran onto the shoulder of the highway.

The lawsuit said Patrick was hit on the shoulder, and alleges the truck driver was speeding and was “fatigued or impaired.”

The 7-page lawsuit was filed Thursday by Columbia attorney Matthew Woods, and names the truck driver and his employer,
YRC, Inc.

The Police investigation determined there was not probable cause to believe there was a criminal offense committed by the truck driver.
