Bocomo Bay owner sentenced to three years in prison for selling synthetic marijuana

The owner of Bocomo Bay smoke shop was sentenced to three years in federal prison and two years of supervised release on Thursday.

Kevin E. Bay pleaded guilty in July 2016 to helping sell more than $2 million in synthetic marijuana, often known as K2.

The judge said he considered Bay’s declining health. In the past two years, Bay had one kidney removed and is undergoing treatment for cancer. Michael Gunter, Bay’s attorney said he was diagnosed four years ago with cancer and the survival rate after five years is very low.

Bay took the stand and apologized for his charges and said he regretted his actions.

“I am very remorseful I had any role in this,” he said. “I would like to do some good with the life I have left.”

Gunter asked the court to consider only probation and no prison time.

The U.S. government had recommended a sentencing of five years.
