Sedalia man accused of killing a baby set to head to court Thursday

BENTON COUNTY, Mo. (KMIZ)

A Sedalia man who is accused of killing his own child in 2022 will face a judge Thursday to see if prosecutors can get his bond removed.

Danial Fitzgerald, 24, is charged with second-degree murder and first-degree endangering the welfare of a child. He was arrested back in Feb. of 2023, but posted a $50,000 bond shortly after.

Fitzgerald's hearing is scheduled for 1:00 p.m. Thursday at the Benton County Circuit Courts.

According to a probably cause statement, the 9-month-old baby was found dead after a non-injury vehicle crash. A Missouri State Highway Patrol Trooper noticed injuries to the baby's head, face, genitalia and extremities.

The mother of the baby allegedly told the Trooper the baby had been with Fitzgerald that morning and day before her death.

She had stated the baby looked like she was "dying," according to a probable cause statement.

Fitzpatrick has also made a request for a change in venue for the case. He is asking for it to be moved to Henry County.
