Montgomery City woman at residence where child died from alleged overdose charged with illegal gun possession

A woman at a residence where a toddler died last year from an alleged overdose has been charged with three felonies and a misdemeanor.

Brittany Maheny, of Montgomery City, was charged on Friday with three counts of illegal gun possession and one count of misdemeanor possessing a defaced gun. A warrant was issued for her arrest and a $5,000 bond was set. A court date has not been set.

The probable cause statement says while law enforcement was investigating the death of a child at the scene on Sept. 3, 2024, police found several guns in the residence. The statement says four guns were found and Maheny is not allowed to own firearms because of a prior felony conviction.

Brian Danter, of Montgomery City, was charged in the case with second-degree felony murder, second-degree drug trafficking and two counts of drug possession. A case review is scheduled for 9 a.m. Friday, March 7.

According to the probable cause statement, Danter found his 2-year-old son unresponsive on Sept. 3, 2024. Law enforcement saw the body of the child on the kitchen table near a plastic bag containing “a crystalline substance.” Pill containers with white residue, capsules with white powder, two scales and another plastic bag containing white powder was found in the home, the statement says. The substances tested positive for fentanyl and methamphetamine, court documents say.

Danter allegedly told Missouri State Highway Patrol troopers that he administered Narcan to the child. Danter allegedly told law enforcement that the child had placed a capsule in his mouth the year before at a prior residence, was brought to an area hospital and tested positive for fentanyl, the statement says. Danter allegedly said that he wasn’t sure if the child ingested drugs in September, but claimed it was possible.

In another active Montgomery County case, Danter was charged with drug possession, misdemeanor illegal possession of drug paraphernalia and an infraction of driving without a license. A case review in that case is scheduled for 9 a.m. Monday, March 10.
