Man accused of manslaughter in fatal Kansas crash arrested in Sedalia

A man who is charged with involuntary manslaughter in Kansas was arrested last week in Sedalia.

Timothy Smith was charged in Pettis County on Friday with being a fugitive from out of state. A hearing was held on Monday and Smith appeared by video from the jail, court records indicate. Court information says Smith refused extradition to Kansas. A case review was scheduled for 10 a.m. Tuesday, Jan. 7.

A bench warrant was issued for Smith in Leavenworth County in February 2023 for failure to appear, according to court records. Leavenworth County court documents provided to ABC 17 News say Smith was accused of killing James Hadley Wilson in a crash on Dec. 30, 2022, while Smith was allegedly under the influence of drugs.

Smith is charged in Leavenworth County with involuntary manslaughter, aggravated endangering the welfare of a child, misdemeanor driving under the influence, misdemeanor driving without insurance and two infractions: Driving a child without a passenger safety restraint and failure to wear a seatbelt.

Pettis County court documents say that Sedalia police on Thursday saw Smith walk out the back door of a residence in the 800 block of East 15th Street and then go back inside the building. The statement says police had “knowledge that Timothy had a warrant for his arrest in Kansas for homicide that carried no bond.”

Police knocked on the door of the residence and a woman answered it, the statement says. The woman allegedly claimed Smith was not there, but he was eventually found in a bathroom, court documents say.
