A Sedalia man was charged with five felonies on Saturday after he was accused of pulling a gun on someone at a residence and taking a minivan.

Marquette Smith, 32, was charged on Saturday in Randolph County with first-degree attempted assault, first-degree burglary, second-degree kidnapping, unlawful use of a weapon and first-degree tampering with a motor vehicle.

He is being held at the Howard County Jail without bond. A court date has not been scheduled.

According to the probable cause statement, police were called on Saturday to a Moberly residence about a man who allegedly brandished a gun and left in a red Kia Sedona. A woman allegedly told police that Smith entered another person’s residence and pulled out a gun, the statement says.

Court documents claim that Smith said “The only reason I did not shoot you is because this is not my place.” Smith then allegedly forced a woman to get into a vehicle he did not have permission to drive. The woman later told police that she was afraid Smith would shoot, if she did not get in the vehicle, court documents say.

A man allegedly told police that Smith was pointing the gun while his finger was on the trigger, the statement says.

Smith allegedly admitted to police that he entered the residence and had a gun, but denied pulling out the gun from his pocket, court documents claim. Smith later allegedly told police that he had the gun for protection because of prior altercations, the statement says.

Smith allegedly told police the gun wasn’t loaded, but police found the gun, which contained live ammunition, the statement says.
