Brunswick man accused of shooting into Saline County home
MIAMI, Mo. (KMIZ)
A Brunswick man was charged with a pair of felonies on Wednesday after he was accused of shooting into a Miami, Missouri, home on Tuesday.
Jimmy Penry, 46, was charged with unlawful gun possession and tampering with evidence. He is being held at the Saline County Jail without bond.
The Saline County Sheriff’s office stated in a Tuesday press release that four people were taken into custody after shots were fired into a home in the 100 block of East Mechanic Street. Penry is the only name included in the probable cause statement. No injuries were reported.
According to the probable cause statement, one of the victims told law enforcement that she, her fiancé and three boys took cover in the middle of their kitchen as seven shots were fired. She then claimed the shooter fired two more shots and left. The vehicle then returned and the victim claimed the shooter had a handgun, according to the statement.
Troopers stopped a vehicle matching a description given by the victims at the intersection of High Street and Highway 41 in Miami. Penry was driving and two passengers – identified as CB and LH – were with him, the statement says. One of the victims allegedly referred to the driver of a white Dodge as “Jimmy” but did not provide a last name, the statement says. Deputies saw several holes in the house, as well as shell casings in the truck, the statement says.
Another victim allegedly told deputies that he was near his driveway when “Jimmy” pulled up, pulled out a gun and demanded his four-wheelers. The statement says that the victim pulled out a gun of his own and walked back to his house after an exchange of words. Penry then allegedly fired two shots at the victim, but hit the house. The victim did not fire back, claiming the children were in the woods behind Penry and did not want to fire a gun in their direction, the statement says.
Penry then allegedly fired the gun several more times and drove off. The children came back to the residence and all five victims were inside the house when the Dodge came back and shots were fired again, the statement says. A red Dodge then began driving around the house, but that vehicle was not recognized by the victims.
The adult male victim allegedly told law enforcement that he did not know why Penry thought he had his four-wheelers. The victim claimed in the statement that he had issues a few weeks prior about people showing up at his house, demanding "four-wheelers." The statement says deputies also responded to that incident, and the people who arrived to the house were given trespass warnings.
The statement says a man – whose initials are TC in the statement -- driving a red Dodge was stopped by Carroll County deputies. The statement claims troopers saw the driver of the red Dodge Dakota alongside a white Dodge. The red Dodge drove away when Saline County deputies detained the occupants of the white truck – Penry, CB and LH.
LH allegedly told law enforcement at the jail that he was riding with Penry and Penry’s girlfriend, CB, to “go get a four-wheeler,” according to court documents. He claimed they arrived at a residence, where a man fired a gun at them, the statement says. He claimed he told Penry to drive away, but Penry fired several rounds and then circled the block in the truck, the statement says. LH allegedly said Penry threw the gun away into the weeds near some trees. He claimed no one else fired a gun at the house.
CB allegedly told law enforcement that they went to Miami so Penry could take back “four-wheelers that were stolen from him, and he planned to confront the man who had possession of them,” according to the statement. She also claims the man at the house fired at them.
Penry allegedly told deputies that another person sold the victim the four-wheelers without his permission and that he traded motors with the victim before. Penry denied shooting a gun and claimed he got shot at from multiple angles, according to the probable cause statement. He also claimed TC was not involved in the incident.
There were three people with matching initials of those listed in the probable cause statement, according to the Saline County Jail’s online records. All three were placed on 24-hour holds and were released on Wednesday.
