Case dismissed for Moberly man accused of murder

Charges have been dismissed for a Moberly man who was accused of murder in 2017.

Randolph County Prosecutor Stephanie Luntsford told ABC 17 News that the case against John Fitzgerald Tucker, 58, was dismissed. She also stated that there is no statute of limitations for the charge, so the state could still refile .

“The court issued a ruling suppressing key evidence that made it difficult for the State to proceed at this time. The ruling suppressed physical evidence that linked the defendant to the crime,” Luntsford said in an email.

According to previous reporting, Tucker was charged with first-degree murder in relation to the death of Christopher James. Tucker is accused of shooting and killing James on Feb. 2, 2017, at the Sherwood Glen Apartment Complex on the 1000 block of S Williams in Moberly.

Tucker was initially arrested in Illinois, according to previous reporting. Previous reporting indicates Tucker and James' girlfriend both lived at the apartment complex. The woman was allegedly involved in relationships with both men, according to the report.
