Man arrested after Memorial Day weekend UTV crash charged with DWI
COLUMBIA, Mo. (KMIZ)
A man arrested after a crash between his UTV and a car in Miller County on Memorial Day weekend has been charged with two felonies.
Miller County prosecutors charged Carter D. Halley of Brumley with two counts of DWI causing serious injury and two misdemeanors -- failure to yield and driving a UTV on a highway.
A probable cause statement filed Monday says Halley and the pregnant woman in the car he hit each suffered serious injuries in the crash. The statement says Halley had "serious head trauma."
The trooper who filed the statement wrote that Halley smelled like alcohol and that a breath test showed his blood-alcohol level was .137. The legal limit to drive is .08.
The Missouri State Highway Patrol said the crash happened at 7:19 p.m. at Route U and Kinderhook County Road.
The crash report states that 23-year-old Halley was trying to turn onto Kinderhook County Road on a UTV when he was hit by a car driven by a woman from Edgar Springs, Missouri. Â
The woman tried to avoid hitting Halley but couldn’t, sending the UTV airborne and throwing Halley from the vehicle, according to the report. The UTV landed in a ditch.Â
Troopers arrested Halley at the scene, according to an online arrest report.
The woman was taken to Lake Regional Hospital and Halley was flown to University Hospital after the crash.
Halley's lawyer made a court appearance Tuesday and his bond was altered to allow him to stay out of jail, according to online court records.
