Man charged with murder asks for case to be dismissed
JEFFERSON CITY, Mo. (KMIZ)
A Fulton man who is charged with first-degree murder wants his case dismissed.
Chris Niemet, 46, is accused of killing his classmate, Greg Jones in April 1991 in Russellville. Jones was 14. Niemet also would have been 14 at the time.
Niemet was charged in 2020. On Friday a motion to dismiss the case was filed.
Niemet and his attorneys claim there is not enough evidence to accuse him of first-degree murder or even connect him to Jones’ murder.
According to a motion from Niemet's attorney, the only evidence in the case is Jones' body and two puncture wounds to the skull, which were allegedly caused by bullets. Niemet’s attorney claims there is no weapon, witness or forensic evidence connecting him to the crime.
ABC 17 News reached out to the defense lawyer and prosecuting attorney. The defense has yet to respond, while the prosecution declined to comment.
A motion hearing is scheduled for 1:30 p.m. at the Cole County Circuit Court. A pre-trial conference is set for 9 a.m. Friday, June 23; while a jury trial is scheduled for 9 a.m. Monday, July 17.
