Phelps County deputies arrest two accused of causing serious physical injuries to 67-year-old man
UPDATE 2:30 pm: Eubanks has been charged with assault.
According to the probable cause statement, the victim was walking when Burns punched him in the face, knocking him to the ground. While on the ground, Burns and Eubanks kicked the victim several times in the face and ribs.
Officers said the victim had a swollen eye, possibly a broken nose, a broken tooth, swollen face and mouth and his face covered in blood.
Eubanks told deputies that the victim was on his property and looking into his house, so he confronted him. Eubanks also claimed that the victim struck him first. Officers said there was no evidence of Eubank’s story.
Officers also said a large amount of blood was found on Eubanks’ sock and pants even though he denied kicking the victim.
ORIGINAL STORY: Phelps County deputies arrested Douglas Eubanks, 34, and Michael Burns, 56, on Friday after officers were dispatched to the Phelps County Regional Medical Center for an assault.
Deputies said when they responded to the hospital, they learned a 67-year-old man had been assaulted by Eubanks and Burns.
Officers said the assault happened when Eubanks and Burns contacted the victim while he was walking on Clementine Outer Road. The two were accused of becoming aggressive, assaulting the victim and causing serious physical injuries.
Eubanks and Burns were arrested on suspicion of assault. Warrants were later issued for the two for assault in the first degree with serious physical injury or special victim.
Bonds were set at $250,000 for the two men.
