Trial date set for man charged in officer-involved shooting

A jury trial has been scheduled for the man who was shot by a Sturgeon police officer during an incident in July.

The trial for Charles Simcoe is set for Jan. 24 at 9 a.m. in Boone County Court.

Simcoe was charged in September with third-degree domestic assault, felonious restraint and assault of a law enforcement officer in the second degree.

According to court documents, a woman called authorities and said Simcoe was attacking her at a home in Sturgeon in July. Officials said the arriving Sturgeon police officer shot Simcoe after he allegedly pointed his gun, which later turned out to be a BB gun, at the officer.

Simcoe is currently being held at the Fulton Reception and Diagnostic Center.
