Miller County prosecutor speaks out after judge drops sodomy charges

A Mid-Missouri prosecutor is speaking out against a judge’s decision in an alleged child sodomy case Sunday.

Cole County Judge Patricia Joyce dismissed two counts of forcible sodomy against Aaron Fisher Friday.

Fisher was accused of sodomizing and beating a 5 month old child in Miller County in 2009.

ABC 17 News was in the Miller County courtroom in November 2014 when a judge set aside and voided Fisher’s guilty plea.

Court records showed Judge Joyce ordered Fisher to b released from jail, saying his rights to a speedy trial were violated.

Sunday, Miller County Prosecutor Ben Winfrey said he was prepared to go to trial next month in the case and disagrees with the decision.

Winfrey said he has contacted to the Attorney General about an appeal.
