Columbia homicide suspect charged with involuntary manslaughter

New details have emerged Tuesday in Sunday night’s deadly shooting in Columbia.

It happened on White River Drive in North Columbia.

Police arrested and charged 19-year-old Stone Midgyett with a class C felony of involuntary manslaughter.

Midgyett reportedly shot and killed 17-year-old Deante Smith and appeared in court for the first time Tuesday.

During Midgyett’s first appearance, which was via video, he seemed mellow and was compliant with the judge’s questions.

Right now Midgyett doesn’t have an attorney, but has applied for a public defender.

Columbia Police Chief Ken Burton sat down with ABC 17 Tuesday morning

He said gang activity is not being ruled out at this time.

“You know, I think that’s always a possibility. I think the main thing it’s tied to is foolishness. Here’s a young life that’s been ended and another one that’s going to be greatly affected by what happens on criminal charges and it’s absolutely foolish,” said Burton.

According to reports, Midgyett and Smith were involved in an argument between two groups with Midgyett and Smith.

Midgyett claims he fired a gun at him as he was running away from the fight and that’s when Midgyett said he fired back.

Police said Smith was shot in the back of the head by Midgyett and was found in a nearby field.

Midgyett claims he didn’t know where Smith was in the field, but was firing in the general area he ran to.

Two people in the area were wounded by gunshots coming from Midgyett’s direction.

Assistant Boone County Prosecuting Attorney Tracey Gonzales couldn’t comment much on whether or not involuntary manslaughter was a high enough charge for the killing.

“At this point in time I can’t comment on anything. This is a pending case with ongoing investigation. So, I’m not permitted to comment on anything,” said Gonzales.

A candlelight vigil is set to start at 5:30 Tuesday night on White River Drive for Smith.

Midgyett’s bond is set at $500,000.
