Dustin Deacon facing charges since killing Coleman in father’s defense

Dustin Deacon, a Columbia man who escaped charges in the death of Brandon Coleman is now facing multiple charges since killing Coleman in his father’s defense.

In May 2013, Deacon shot and killed Coleman on Ann Street in Columbia.

The Boone County Prosecutor said Deacon shot Coleman to protect his father and didn’t file charges.

Coleman’s mother took it to the Department of Justice for a second look.

In January, federal prosecutors also did not file charges, stating their investigation was over.

Weeks later Deacon had a run-in with the law; then again a month later.

According to court documents, on Jan. 28th, Deacon was arrested for assaulting a man at the Ace Hardware on Business Loop 70. Then, just one month later, he was arrested for stealing $724.50 worth of merchandise from the Kohl’s on Green Meadows.

“Mr. Deacon initially bonded out pursuant to the bond schedule before the court could review our recommendation,” said Boone County Assistant Prosecutor Roger Johnson. “Subsequently, we filed a motion to take that up and review our recommendation.”

Johnson said his office recommended a $10,000 cash-only bond, which a judge later granted, saying Deacon was a danger to the community and did not follow the judge’s orders on two previous cases.

Deacon has four cases being handled by Johnson.

“I’ll have some time to talk with his attorney and negotiate, both our office and his attorney will do some investigation to prepare the cases for trial,” Johnson said.

Deacon is being held at the Boone County Jail on a $35,500 bond; $20,000 of that bond is cash-only.

Johnson said he believes Deacon will likely be set for trial in May.

Deacon is already scheduled for a trial April 29 for a previous tampering with a motor vehicle charge.
