Man accused in 1997 shooting appears in court
The suspect in a 1997 shooting in Moberly appeared in court Wednesday for a preliminary hearing.
Ollie James III was arrested in January for allegedly shooting and robbing a 48-year-old man at Richard’s Steakhouse in Moberly.
The victim, Richard Greiner, testified about the attack in the parking lot of the steakhouse as he was closing the restaurant for the night.
Another witness testified that James admitted to the shooting via recording to his cousin, David James.
James III’s lawyer, Kay Evans, called David James as a witness to try to convince the court to exclude James III’srecording on the theory that David James was acting as an agent for the police.
The court rejected that argument and found probable cause.
James III is charged with first-degree assault and is being held on a $100,000 bond and will be arraigned on April 9th.
