Morgan County man charged with incest, statutory rape

A Morgan County man has been charged with incest after he was accused of raping a 14-year-old girl.

According to the probable cause statement, Gilbert Silvey had been having sex with the victim since he was released from prison in 2013.

Silvey was previously found guilty of child molestation in 2009 and was sentenced to five years in prison.

The victim told Morgan County deputies that she had lost her virginity to Silvey. The girl also said that Silvey would take her phone away from her or have it turned off and tell her he would let her have it back if she would allow him to have sex with her.

Deputies said that the victim was 11 or 12 when Silvey started to rape her.

Silvey was accused of sometimes using condoms but not always. He would buy the victim pregnancy tests whenever she thought she was pregnant, officers said.

Deputies said they tried to talk to Silvey about the allegations but he refused to speak.

According to the probable cause statement, Silvey was on probation for failing to comply with sex offender registration.

Silvey was also charged with statutory rape and statutory sodomy.
