Brian Adkison found guilty of forcible rape

Brian Adkison was found guilty of forcible rape on Friday, but not guilty of deviate sexual assault following his third mistrial in January. The jury deliberated for more than ten hours starting Thursday night and lasting until Friday morning.

The trial initially got underway at 9:00 Wednesday morning at the Boone County courthouse in downtown Columbia. There were seven witnesses over the course of two days, including law enforcement, health professionals, and people who knew Adkison’s ex-girlfriend.

Adkison’s ex-girlfriend took the stand for several hours Wednesday.

The prosecution questioned her about the incident between Adkison and herself in May 2013.

They also presented a recording of a phone conversation between her and Adkison a day after the incident, but Adkison didn’t admit to anything on the recording.

The defense also questioned her about her statements in the deposition and accused her of making up the story in order to keep Adkison away from her permanently.

On Thursday, the prosecution called Deanna Allen, a registered nurse who gave the victim a sexual assault exam. Both sides questioned her about the exam and photos of the victim’s injuries.

The nurse said the injuries do not indicate anything, and are not an accurate measure of a sexual assault.

The prosecution called Det. Mitchell Baxley to the stand as well. He interviewed Adkison, and the court saw a recording of that exchange.

In the interview, Adkison denied assaulting his ex-girlfriend. He said she consented to sex, and was more angry about the money he owed her.

The defense also questioned an MU medical student who knew the victim.

In Adkison’s first Boone County trial in January, the jury found him not guilty of first-degree burglary after deliberating for six and a half hours, but could not come to an agreement on the deviate sexual assault and forcible rape charges.

Adkison had another recent trial in Chillicothe for kidnapping and domestic assault. That was also declared a mistrial.

He is also accused of leading police on a manhunt near the Lake of the Ozarks, before escaping from the Caldwell County jail in northwest Missouri. Police later found him hiding in a nursing home in Ohio.

Sentencing for Adkison will occur in September, and he could receive up to 30 years in prison for the conviction.
