Man charged with assault after allegedly stabbing another man with pen in bathroom
JEFFERSON CITY, Mo. (KMIZ)
A Jefferson City man was charged with three felonies after he allegedly stabbed another man with a pen in a public bathroom on Wednesday.
Timothy Dale was charged with first-degree assault, armed criminal action and tampering with evidence. He is being held at the Cole County Jail without bond. Dale appeared in court by video from the jail on Friday and pleaded not guilty. Dale requested a public offender.
A bond review hearing is scheduled for 10:30 a.m. Friday, June 28 at the Cole County Circuit Court. A preliminary hearing is set for 2 p.m. Thursday, July 18.
According to the probable cause statement, the victim and Dale got into an argument on Wednesday. The victim allegedly stated that he went into a public restroom and Dale followed him, the statement says. Dale was allegedly holding a pen and piece of paper. He then allegedly dropped the paper and started stabbing the victim, the statement says.
Police saw stab wounds on the man’s neck, left arm, face and stomach, the statement says. The man refused medical treatment, according to court documents.
A witness allegedly told police that he and another man went into the bathroom, saw Dale and the victim fighting and broke up the fight, the statement says. The witness allegedly saw Dale wash off the bloody pen in a sink, wrap it in toilet paper and flush it down the toilet, court documents say.
The second witness did not cooperate with police, said he didn’t see anything, but claimed to have mopped up the blood after the other witness broke up the fight, according to court documents.
Dale was arrested while wearing a blood-stained, button-up shirt, court documents say. Dale allegedly denied an argument occurring and claimed the second witness attacked the victim, the statement says.
