Malcolm Redmon’s trial expected to be pushed back

A man in the middle of several shootings in Columbia over the past few years was in court Tuesday asking for a new judge.

Malcolm Redmon, 30, was arrested in November for violating his home detention sentence. He admits to being involved in at least one 2012 fight at Boone Tavern that led to a shooting.

According to court documents, he admitted to having drugs. He was given a one year jail sentence that was reduced to home detention.

Redmon was scheduled to have his trial next week, but the trial will likely be pushed back a few weeks because of a strange request made in court. Redmon and his lawyer asked circuit court Judge Jodie Asel to remove herself from the case because they’re going to call her as a witness.

Redmon’s lawyer, Adam Dowling, told ABC 17 News the judge heard a prior case involving Redmon. He wouldn’t go into detail about that case, but he said the information she has from that can be used in his current case.

The judge did recuse herself. The case now goes back to 13th Judicial Circuit Court judge Christine Carpenter. It wll be up to her to assign another judge or not. Prosecutors and Redmon both hope that happens shortly.

“We’re asking that she strongly consider assigning it to a judge of the 13th Circuit given the fact that judge Asel is likely to be a witness in this case,” Dowling said.

Redmon’s lawyer isn’t sure when that next court date will be. But he hopes it happens soon because he and prosecutors are ready for the trial.

If convicted, Redmon could receive a sentence up to seven years in prison.
